All electrical installation work referenced on this Website is performed exclusively by independent, licensed electrical contractors who are separate legal entities from this Website. The contractors in our network are independent businesses, and we do not control, direct, or supervise their work in any manner.

5. Contractor Matching Service

5.1 Independent Contractors

When you submit a quote request through this Website, we may forward your information to up to three (3) independent, licensed electrical contractors in the Kitchener-Waterloo region. These contractors operate as independent businesses and are not our employees, agents, subcontractors, partners, or affiliates.

5.2 No Warranty of Contractor Performance

While we make reasonable efforts to verify that the contractors in our network hold active ECRA/ESA licences and carry appropriate liability insurance at the time of their initial onboarding, we do NOT guarantee, warrant, or represent the quality, completeness, timeliness, safety, legality, or suitability of any contractor’s work, conduct, pricing, materials, or business practices. We do NOT guarantee that any contractor’s licences, insurance, or qualifications remain current or valid at the time they perform work at your property.

5.3 Your Responsibility

You are solely responsible for independently verifying any contractor’s current licensing status through the ECRA/ESA online licence verification tool, insurance coverage, references, and qualifications before entering into any agreement or permitting any work on your property. Any contract you enter into with a contractor is solely between you and that contractor. We are not a party to any such agreement and bear no responsibility for the performance, non-performance, or outcome of any work.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, INCLUDING THE LAWS OF THE PROVINCE OF ONTARIO:

(a) We, our owners, officers, directors, employees, agents, affiliates, and partners shall NOT be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use this Website, the information provided on this Website, or any contractor services arranged through this Website.

(b) We shall NOT be liable for any damages, injuries, losses, or costs arising from any electrical work performed by any contractor, whether or not that contractor was connected to you through this Website. This includes, without limitation, property damage, personal injury, electrical fires, code violations, failed inspections, insurance claim denials, and any other consequences of electrical work.

(c) We shall NOT be liable for any damages arising from your reliance on any information, content, cost estimates, technical specifications, or recommendations presented on this Website.

(d) Our total aggregate liability to you for all claims arising out of or related to this Website and these Terms shall not exceed the amount of one hundred Canadian dollars (CAD $100.00).

(e) The limitations and exclusions in this section apply regardless of the theory of liability, whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless this Website, its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements) arising out of or in connection with: your use of this Website; your violation of these Terms; your interaction, communications, or contractual relationships with any contractor; any claim by a third party related to your use of this Website or the services arranged through it; your violation of any applicable law or regulation.

A, or any other applicable consumer protection legislation that cannot be excluded or limited by contract. 19. Dispute Resolution

If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of the Province of Ontario as set out in Section 13.
